Booking Terms & Conditions:-

The agreement presented herein, commonly known as the "Terms," serves as the comprehensive understanding and contractual agreement governing the relationship between you, the tour participant ("Participant"), and TravQuench Travel Private Limited ("TravQuench Travel Private Limited," "we," or "us"). It encompasses all aspects of bookings, reservations, tours, or any transactions conducted with TravQuench Travel Private Limited ("Tour" or "Tours").

Upon choosing to book a tour with us, submitting a deposit or making the payment in full, or affixing your signature to this agreement or saying Ok to book, acknowledging our travel plan email to book, you willingly acknowledge and embrace all stipulations outlined herein. This acceptance extends not only on your behalf but also includes all individuals listed on the booking, encompassing minors under your guardianship, care, or control ("Minor" or "Child"). Individually referred to as "Traveler" and collectively as "Travelers," this acceptance directs us to carry out services for each and every Traveler.

It is crucial to recognize that this agreement encapsulates the entirety of the understanding and obligations binding both the Participant and TravQuench Travel Private Limited. The act of booking, making a deposit, or signing this agreement signifies a collective agreement to abide by the terms and conditions herein, ensuring a mutual commitment to a seamless and enjoyable travel experience.

RESERVATIONS, ACCEPTANCE OF BOOKING, & PAYMENTS:

A booking is not accepted, and there is no contract for services between us, until the required cost of the booking is paid and you receive written confirmation from us. We reserve the right to treat any reservation that is not fully paid according to the reservation and payment terms as a cancellation and subject to the cancellation terms below.

PASSPORT, VISAS, VACCINATIONS & OTHER ENTRY REQUIREMENTS:

You and those traveling with you assume sole responsibility to independently confirm all documentation requirements for all passports, visas, vaccinations, immunizations and other entry and/or travel requirements of each of your destinations (collectively, the “Travel Requirements”). We accept no liability if you are refused entry onto the flight or into any country due to failure on your part to carry the correct passport, visa or other documents required by any airline, authority or country. You must have a passport which is valid for six months after your intended date of return. You must ensure you have correct visa and health entry requirements for all countries visited including countries you may just be transiting through. This includes all stops made by the aircraft even if you do not leave the aircraft or airport. If your passport is in its final year, you should check with the Embassy of the country you are visiting. Flight tickets must be issued as per their name as mentioned on their passports.

As your trusted travel coordinator, we are committed to providing you with seamless and unforgettable experiences. To ensure transparency and a smooth journey, it's important to familiarize yourself with our terms and conditions. In our quest to deliver exceptional services, we collaborate with various agents, affiliates, and third-party suppliers—let's call them our "Suppliers." It's crucial to understand that these entities operate independently. They are not under our direct control or management, and they do not represent us as agents or employees. Each Supplier has its own terms and conditions, and their services are subject to compliance with local laws and regulations. It's important to note that airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage. You, as the traveler, are bound by these conditions concerning the relevant common carrier or supplier. These conditions may contain limitations or exclusions of liability on the part of the respective transport provider or other supplier, often subject to various international conventions. Your understanding of and compliance with these conditions contribute to a smooth and informed travel experience.

While we strive for perfection, the travel landscape can be unpredictable. In the unfortunate event of a Supplier's delay, cancellation, overbooking, or strike, TravQuench Travel Private Limited regrets to inform you that refunds will not be provided. We want to set realistic expectations and emphasize that we cannot be held responsible for any negligent or willful acts or failures to act on the part of Suppliers or other individuals/entities.

Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage. As a traveler, you are bound by these conditions. They may include limitations or exclusions of liability, often subject to various international conventions. Your awareness and compliance with these conditions contribute to a well-informed travel experience.

To cover planning and management costs, TravQuench applies a 10% Administration Fee. This fee is non-recuperable due to the invested time and materials. We believe in transparency, and this fee ensures that we can continue to provide you with exceptional planning and support throughout your journey. Please be advised that for all date changes and cancellations, an administration charge will be applied in addition to the respective date change and cancellation fees. This administration charge is non-refundable under all circumstances, even in cases where hotels, airlines, or transport vendors may offer a full refund due to any reason. Our administration charge is designed to cover the administrative costs associated with processing date changes and cancellations. It is important to note that regardless of external policies, our rules and this non-refundable administration charge will be applicable to maintain the efficiency and operational integrity of our services. We appreciate your understanding and cooperation in adhering to these terms. Detailed Terms and Conditions of the booking will be shared with the guest before booking the holiday.

TOUR PRICES:

Inclusions and exclusions of the tour will be shared with you before booking the travel. Prices and availability are not guaranteed and may change without notice, until your deposit/payment has been received by TravQuench Travel Private Limited and your booking has been confirmed by us in writing. If your deposit/payment is not received by TravQuench Travel Private Limited, on or before the Deposit Due Date, reservations will be automatically cancelled. In the event of a marked increase or decrease in foreign exchange or tariff rates, taxes, fees or surcharges, as TravQuench Travel Private Limited shall determine, costs are subject to revision.

PAYMENTS:

All payments must be made in full and at the time of confirming the holiday. Payments can be made by bank transfer only. Should you have any doubt regarding the veracity of payment instructions received you must call our office before making payment to verify payment details. TravQuench Travel Private Limited will not be held financially responsible for payments that are sent to fraudulent accounts.

Date change and Cancellation Policy:

Our commitment to providing a seamless booking experience involves navigating the diverse terms and conditions set by airlines, hotels, transportation, and excursion suppliers. To ensure transparency, detailed information on these terms will be communicated to you before finalizing any booking. Our dedicated team handles cancellation and date change requests during our regular working hours, Monday to Friday, from 10:30 AM to 7:00 PM, with prompt processing for requests received within this timeframe. For after-hours submissions, rest assured that requests will be diligently addressed on the next business day. We deeply appreciate your understanding and cooperation in following these procedures, as they contribute to our ability to deliver the best possible service tailored to your travel needs. Any requests for changes or cancellations of dates must be formally submitted to our office via email at sales@travquench.com. Such requests will be deemed valid and acknowledged only upon receipt through this specified electronic communication channel, irrespective of the nature of the travel—whether domestic or international.

Administrative Fee:

To cover planning and management costs, TravQuench applies a 10% Administration Fee. This fee is non-recuperable due to the invested time and materials. We believe in transparency, and this fee ensures that we can continue to provide you with exceptional planning and support throughout your journey. Please be advised that for all date changes and cancellations, an administration charge will be applied in addition to the respective date change and cancellation fees. Trip Interruption Insurance:

No refunds are provided for any unused portion of a tour once it commences, including if you leave for any reason. Securing comprehensive trip cancellation and interruption insurance is strongly recommended.

Flexibility in Changes by TravQuench:

TravQuench Travel Private Limited reserves the right to modify, cancel, or reschedule tours for safety, comfort, or Force Majeure. Changes may occur due to unforeseen factors, and any supplemental payments required will be communicated promptly.

Civil Unrest and Refunds:

In cases of civil unrest, refunds depend on the discretion of TravQuench Travel Private Limited, with no refund if the Tour proceeds as planned.

Administrative Fee Details:

A 10% Administration Fee is applied to cover planning and management costs, non-recuperable due to the invested time and materials. In instances of Force Majeure hindering our ability or that of our Suppliers to provide Services, including your Tour:

We may, at our discretion, vary, reschedule, postpone, or cancel any Tour itinerary, with no refunds unless recoverable from Suppliers.

  • · Refunds under Force Majeure are subject to a 10% Administration Fee.
  • · Suppliers, often outside India, may not refund non-refundable deposits, and obtaining refunds is uncertain once deposits are forwarded.
  • · TravQuench Travel private limited, if affected by Force Majeure, will notify you if practicable.

We are not in breach or liable for delays/nonperformance due to circumstances beyond our control, defined as Force Majeure. Force Majeure includes acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/COVID-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances.

In summary, TravQuench Travel Private Limited prioritizes clear communication, considers financial commitments, and strives for flexibility in unforeseen circumstances while maintaining a transparent and fair approach to cancellations and refunds.

LIMITATION OF REMEDIES:

You agree that the sole remedy for any default by TravQuench Travel private limited arising under this Agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, TravQuench Travel private limited shall not be liable for any special, consequential, indirect, incidental or other damages arising out of this Agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if TravQuench Travel private limited has been advised of the possibility of such damages. You expressly waive any right it may have to recover such damages.

OPTIONAL ACTIVITIES THAT MAY BE DANGEROUS:

As part of your journey with TravQuench Travel Private Limited, you may encounter optional activities that add an extra layer of excitement to your tour. However, it's crucial to understand that these activities, such as horseback safaris, hot air balloon trips, or scuba diving, come with inherent risks. While our suppliers take precautions, your safety cannot be guaranteed. Participation in these optional activities is entirely at your discretion; they are not mandatory. TravQuench Travel Private Limited assumes no responsibility or liability for any personal injury or damage incurred during your participation in these activities. We recommend obtaining comprehensive travel insurance that covers trip interruption, cancellation, and medical expenses specific to the activities you may engage in.

Transportation and Local Standards:

Please be aware that vehicle and equipment breakdowns may occur during your tour. TravQuench Travel Private Limited is not liable for injuries or property damage resulting from such incidents. Accommodations and activities may have more relaxed standards, such as unfenced swimming pools or uneven pathways. Your safety is a shared responsibility, and you are encouraged to communicate any discomfort to your guides. Some vehicles may lack seatbelts, and drivers may operate at varying speeds. Life jackets may not always be easily accessible, so please request them when needed.

Close Contact with Wild Animals:

TravQuench Travel Private Limited provides unique opportunities to experience close contact with wild animals. While our tours are designed to be immersive, it's important to recognize that wildlife moves freely around safari camps, which are often unfenced. TravQuench Travel Private Limited cannot be held responsible for injuries or incidents related to encounters with wild animals. Your safety instructions from camp staff should be followed diligently. If you ever feel uncomfortable or have concerns, please communicate them promptly. Your safety is our priority, and open communication ensures a secure and enjoyable experience throughout your tour.

Embarking on a safari with TravQuench Travel Private Limited brings the promise of shared adventure and positive experiences. While we welcome friendly and positive individuals, we want to clarify that neither TravQuench Travel Private Limited nor our independent suppliers assume responsibility for the attitudes or behavior of fellow safari members. Individuals with serious health issues, whether physical or mental, are advised to consider their suitability for the tour. In the event that a participant's behavior is deemed disruptive or potentially harmful, we reserve the right to terminate their vacation without refund or compensation. Additionally, should a participant choose not to partake in certain tour activities, no refunds will be provided for the unused portions. Our aim is to cultivate a harmonious and respectful environment where everyone can enjoy the safari experience to the fullest.

TRAVEL INSURANCE/PROTECTION:

The tour price does not include travel insurance. TravQuench Travel private limited believes that your tour is a significant investment which you should protect and we strongly suggest that you obtain comprehensive travel insurance including medical coverage through a provider of your choice, covering medical, accident/life, evacuation, and repatriation, which might arise as a result of loss, damage, injury occurring to you, as well as any dependents and traveling companions for the duration of your tour. We also strongly recommend that you extend your coverage to include trip interruption and cancellation, curtailment, loss of belongings and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience. To protect your investment given that we cannot provide refunds in most instances, we also strongly urge you to consider a “cancel for any reason” travel insurance policy, which requires timely action as it must be purchased soon after your initial deposit. We will take no responsibility for any costs for loss of personal luggage, money, and goods, medical expenses, theft, damage or cancellation or curtailment of the adventure. You will be charged directly by the relevant service provider for any emergency services you may require.

INCIDENT REPORT PROCEDURE:

If you have any cause for complaint while on your Tour, you must immediately bring it to the attention of your tour guide or to TravQuench Travel private limited, who will attempt to resolve the situation. Failure to do so while you are on the tour will extinguish or reduce your ability to claim compensation from TravQuench Travel private limited. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.

If you are not satisfied after using this notice procedure, you must submit your complaint in writing to TravQuench Travel private limited on the registered email address sales@travquench.com within 2 days of the Tour’s end date.

TOUR DEPARTURE/COMMENCEMENT DATE:

It is your responsibility to be ready to embark on the tour as specified in the itinerary. We are not responsible for any losses due to cancelled or missed flights.

COMPLIANCE WITH LOCAL LAWS & TOUR ETIQUETTE:

You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other tour members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, the local guide/supplier has the right in their sole discretion to remove anyone who they determine to detract from others’ enjoyment of the tour.

INFORMATION IN BROCHURES / ELECTRONIC ADVERTISEMENTS:

All information given in any brochure or otherwise advertised, (including electronic advertisements on the Internet) is, to the best of TravQuench Travel private limited knowledge, correct, but TravQuench Travel private limited cannot guarantee that all such information is accurate. Further, TravQuench Travel private limited reserves the right to change such information before any Tour. The photographs reproduced and information provided depict typical scenes experienced and details on each destination. However, the depicted or described subject matter may not necessarily be seen or experienced while visiting that destination as conditions and itineraries may change, be adjusted, etc. as explained these terms.

SEVERABILITY:

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable, and which achieves, to the extent possible, the original objectives and intent of the original provision.

SUCCESSORS & ASSIGNS:

This agreement shall inure to the benefit of and be binding upon TravQuench Travel private limited and you and your respective heirs, legal and personal representatives, successors and assigns.

MISCELLANEOUS MATTERS:

In addition, we shall not be liable for (a) expenses such as additional hotel nights and meals not specified in the individual trip itineraries, but which may be required to get to or from a trip start or end; (b) expenses due to the delay of a trip for any reason (e.g., bad weather, trail conditions, landslides, flooding, sickness, etc.); and (c) expenses incurred in recovering luggage lost by airlines, belongings left behind on a trip, or in shipping purchases or other goods home from abroad.

Upon choosing to book a tour with us, submitting a deposit or making the payment in full, or affixing your signature to this agreement or saying Ok to book, acknowledging our travel plan email to book, you consent to the exclusive resolution of any dispute related to this agreement or your tour through binding arbitration, in accordance with the prevailing commercial rules of the Delhi High Court. The arbitration proceedings will be guided by substantive Delhi High Court laws. The arbitrator, not any state or local court or agency, holds exclusive authority to address disputes regarding the interpretation, applicability, enforceability, conscionability, or formation of this contract. This includes claims asserting the void or voidable nature of all or part of this contract.

MERGER:

This agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.

TRAVELER’S REPRESENTATIONS:

By acknowledging and accepting the Reservation Confirmation and submitting payment for the designated Tour/ individual flight, hotel, chauffeur, charter flight, train reservation, you expressly acknowledge, understand, and accept the terms delineated herein, including other pertinent tour conditions. It is affirmed that you have thoroughly perused, comprehended, and embraced the stipulations set forth. Furthermore, you declare that neither recent treatment nor awareness of any physical or other condition or disability exists that could jeopardize your safety or that of fellow tour participants. Your intent to procure travel insurance to safeguard your investment is affirmed. In the event of opting out of insurance acquisition, you explicitly acknowledge assuming full responsibility for any financial losses incurred in connection with this Tour.

Acceptance of the Reservation Confirmation and payment for the Tour is hereby recognized as constituting a legally binding agreement. No other representations regarding the legal ramifications of this document have been asserted. You affirm the opportunity to seek clarifications from TravQuench Travel Private Limited has been provided, and your acceptance is applicable to all pages comprising this comprehensive agreement.
