The terms and conditions set forth in this agreement (also referred to as “Terms”) constitute the entire understanding and agreement between you the tour participant (“Participant”) and TravQuench Travel Private Limited, (“TravQuench Travel Private Limited,” “we,” or “us”) with respect to any and all bookings, reservations, tours or transactions made with TravQuench Travel Private Limited(“Tour” or “Tours”).
By booking a tour with us, paying a deposit or signing this agreement, you accept all of the terms in this agreement on your own behalf and on behalf of all persons listed on the booking, including any minor under your custody, care or control (“Minor” or “Child”) (also referred to individually as, “Traveler,” and collectively, “Travelers”), and direct us to perform services for each and every Traveler.
A booking is not accepted, and there is no contract for services between us, until the required cost of the booking is paid and you receive written confirmation from us. We reserve the right to treat any reservation that is not fully paid according to the reservation and payment terms as a cancellation and subject to the cancellation terms below.
You and those traveling with you assume sole responsibility to independently confirm all documentation requirements for all passports, visas, vaccinations, immunizations and other entry and/or travel requirements of each of your destinations (collectively, the “Travel Requirements”). We accept no liability if you are refused entry onto the flight or into any country due to failure on your part to carry the correct passport, visa or other documents required by any airline, authority or country. You must have a passport which is valid for six months after your intended date of return. You must ensure you have correct visa and health entry requirements for all countries visited including countries you may just be transiting through. This includes all stops made by the aircraft even if you do not leave the aircraft or airport. If your passport is in its final year, you should check with the Embassy of the country you are visiting. Flight tickets must be issued as per their name as mentioned on their passports.
TravQuench Travel Private Limited uses the service of agents, affiliates and/or third-party suppliers for various services provided for or associated with your Tour, including but not limited to flights, lodging, meals, transportation, sightseeing, and activities connected to your Tour (“Supplier” or Suppliers”). While we use our best efforts to select the Suppliers for these components of your Tour, you acknowledge that you are aware and clearly understand that these Suppliers are independent contractors, are not managed or controlled by us, and are not our agents or employees. A Supplier’s services are subject to the Supplier’s own terms and conditions, and the local laws and regulations of the relevant country. We will not provide any refund for a Supplier’s delay cancellation, overbooking, or strike. You acknowledge and agree that TravQuench Travel Private Limited is not responsible for and cannot be held liable for any negligent or willful act or failure to act of any Supplier, or of any other person or entity.
Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage, and you will be bound by these as far as the relevant common carrier or supplier is concerned. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other supplier, and they are often also subject to various international conventions.
Airline tickets are normally highly restrictive, non-refundable and non-transferrable and are normally issued prior to your departure date. You are responsible for any increases in transportation fares, including airfares, up until the time the tickets are issued and for all cancellation, transfer and modification charges and change fees. Neither TravQuench Travel Private Limited nor its suppliers have control over airline or other transportation company operations. Thus, in addition to other limitations of liability set forth in these Terms and Conditions and other agreements between us that govern your Tour, you agree that TravQuench Travel Private Limited is not responsible or otherwise liable for any damages arising from or related to any airline timetable/schedule changes, delays, cancellations, missed connections, mechanical problems, inclement weather, seating reassignments, lost/delayed/stolen/damaged baggage, screening and security delays, refused boarding or failures to properly check-in.
TravQuench Travel Private Limited is not responsible or otherwise liable for the cleanliness of rest rooms, delays in immigration and customs, safety issues, for circumstances, situations and conditions when traveling to other countries or on safaris or for other “first, second or third world country happenings.” TravQuench Travel Private Limited is not responsible for travel restrictions that are placed on travelers going to or coming from any country. Any additional costs associated with travel, regardless of the reason, circumstance, world events, pandemics or otherwise, will be at the expense of the traveler.
TravQuench Travel Private Limited or its independent suppliers may find it necessary to make last minute changes to the accommodations due to local conditions which are beyond its/their control. TravQuench Travel Private Limited makes no guarantee about the suitability or availability of accommodations and if particular accommodations sought are unavailable, TravQuench Travel Private Limited will do its best to reserve comparable accommodations, if possible. Normally changes are of equal or superior quality. If a substitution of equal or superior quality cannot be arranged, you will receive a refund for the difference in cost, if any. No charge will be made for upgraded accommodations.
Unless otherwise noted, tour prices quoted in our brochure, website and in all our proposals are per person, based on two people sharing a double room. Tour prices include TravQuench Travel Private Limited’s planning, handling and operational charges in addition to supplier costs and fees (typically non-refundable), are quoted in INR and, subject to these Terms and Conditions, are based on the current in-house rate of exchange and tariff. Tour prices include accommodations, meals as specified, transfers, sightseeing as specified, hotel taxes, entrance fees to included features as specified, park fees, professional English-speaking guides for transfers and all tours as specified in the itinerary. Tour prices do not include international airfares and internal airfares unless otherwise specified in the itinerary; cost of passports or visas; items of personal nature such as beverages; laundry unless otherwise stated; phone calls; excess baggage; medical fees incurred; gratuities; airport departure taxes; sightseeing; game drives or meals not included in the itinerary; or travel insurance. TravQuench Travel Private Limited is not responsible for any errors or omissions in any quotes or advertisements, including information posted on its website, which occur as a result of its reliance on incorrect information supplied by third parties.
Prices and availability are not guaranteed and may change without notice, until your deposit/payment has been received by TravQuench Travel Private Limited and your booking has been confirmed by us in writing. If your deposit/payment is not received by TravQuench Travel Private Limited, on or before the Deposit Due Date, reservations will be automatically cancelled. In the event of a marked increase or decrease in foreign exchange or tariff rates, taxes, fees or surcharges, as TravQuench Travel Private Limited shall determine, costs are subject to revision.
All payments must be made in full and at the time of confirming the holiday.Payments can be made by bank transfer only. Should you have any doubt regarding the veracity of payment instructions received you must call our office before making payment to verify payment details. TravQuench Travel Private Limited will not be held financially responsible for payments that are sent to fraudulent accounts.
Date changes, Cancelations and Refunds policy: –
The request for cancellation of your booking must be made in writing to TravQuench Travel private Limited on the email sales@travquench.com. Cancellations are only effective when we receive your written notification of cancellation. There is no refund for any unused services should you leave your tour early for any reason. (This section applies to your cancellation of a Tour. Note that if we make changes to your Tour, up to and including cancellation, different terms apply, as outlined below.)
Our cancellation and refund policy takes into account the fact that we must advance to our suppliers deposits for their services, which are often non-refundable.
If a flight or other delay for any reason prevents you from joining the tour during any point of the tour, it will be considered a “no show” and no refund will be remitted to you. If you cancel your booking, you will forfeit the following:
For all offline cancellation of domestic flights, a standard charge of INR 400 per person per sector, over and above of the airline’s own cancellation charge will apply. For international flight bookings a standard fee of INR 1000 per person would be charged for any offline cancellation, over and above the airline’s own cancellation charge. Cancellations and date changes can only be requested during our working days Monday-Friday from 10:30 AM- 7:00 PM and the date change and cancellation penalties apply for same.
Date change and cancellation policy of every booking will be shared with you before every booking. It’s advisable that you read the date change and cancellation policies and other terms and conditions thoroughly before giving us a go-ahead for the booking.
For rescheduling of domestic flights, TravQuench Travel Pvt. Ltd will charge INR 400 per person per sector as standard rescheduling charges.
For no-show on domestic flights, TravQuench Travel Pvt. Ltd will charge INR 400 per person per sector as standard no-show charges, over and above the airline’s own cancellation and no-show charge.
In case of no-show bookings, you shall be required to make requests for any valid and applicable refunds within 2 days from the travel completion date in case of air/ rail/ cab/ bus tickets and/or the date of check-in for hotel bookings. No refund would be payable for any requests made after the expiry of 3 days of travel completion date/ check-in as aforementioned and all unclaimed amounts for such no-show or unutilized bookings shall accordingly be deemed to have been forfeited.
The refund shall be processed within 30 working days from the date of the cancellation request. Payments made using bank transfer will be refunded by bank transfer only within a maximum of 30 days from date of receipt of placing the cancellation request. All refunds shall be processed subject to processing of refunds by the respective airline/service provider and their cancellation and date change policies apply as well. TravQuench Travel Pvt. Ltd will charge an administrative charge in order to process changes/ cancellations on top of the airlines/ hotel/ Cab/ Excursions bookings. Processing fees charged for booking Air tickets, Hotel bookings, Excursions bookings, Cab bookings, Visa bookings, date changes and cancellation of all travel components is always non-refundable.
If, TravQuench Travel Pvt. Ltd, upon your consent makes the refund to any mode other than to the original source of your payment, and it suffers any claims, damages, costs, loss or expense as a consequence thereof, you shall be liable to indemnify, hold harmless and make good TravQuench Travel Pvt. Ltd to the fullest extent possible. Further TravQuench Travel Pvt. Ltd shall not be liable for any loss sustained by you arising out of provisioning of the wrong details to TravQuench Travel Pvt. Ltd for the purpose of refunds. Please note convenience fee charged at the time of booking will not be refundable.
No refunds will be provided for any unused portion of a tour once the tour begins, including if you leave a tour for any reason, miss the tour’s departure date, or have to be removed from a tour. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, airline default, strikes, personal, family or medical emergencies, your decision to not go on a Tour because of governmental/travel warnings or advisories, including but not limited U.S. State Department or World Health Organization warnings, or any other circumstances beyond our control. For this reason, we strongly suggest that you secure comprehensive trip cancellation and interruption insurance in order to participate on a Tour. We also highly recommend that you consider securing “cancel for any reason” travel insurance, which must be obtained soon after your first deposit is paid for your travels.
TravQuench Travel private limited reserves the right to cancel, alter, modify, postpone or reschedule any tour without prior notice for the safety and/or comfort of clients and for circumstances of Force Majeure (see information below). TravQuench Travel private limited shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder as a result of any actions that it takes or does not take under this section and under this Agreement.
You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. If, prior to departure, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.
Any changes that we make may require a supplemental payment from you. We will advise you in the event such a payment is required.
Regarding civil unrest, once TravQuench Travel private limited has investigated the prevailing situation as it deems fit, it shall remain in the sole discretion of TravQuench Travel private limited whether to proceed with the Tour. If TravQuench Travel private limited is of the reasonable opinion that the Tour may proceed, no refund will be payable to you and the cancellation provisions of this agreement shall apply.
No refunds will be provided if we cancel, alter, modify, postpone, or reschedule any Tour for any reason, whether before or during your Tour. We may, in our discretion without any requirement that we do so, use reasonable endeavors to reimburse you of any payments that you have made reduced by any and all non-refundable deposits and cancellation fees that we have paid to suppliers and other third parties to provide components of your Tour. Our administration costs in planning your Tour are not refundable because of the work involved in planning, booking and management of your Tour itinerary from the moment the Tour is booked. This fee is 10% of the Tour cost (“Administration Fee”), and one that we cannot recuperate, again because the time and materials already invested in the trip.
In the uncommon situation where Force Majeure prevents, significantly hinders, renders it difficult, or makes it impossible for us or our Suppliers to provide the Services including but not limited to your Tour, we and/or our Suppliers shall be entitled to, in our sole and absolute discretion, take one or more of the following steps: vary, reschedule, postpone, cancel any Tour itinerary or arrangement, including Tour dates and the entire Tour itself. We regret that no refunds will be provided if we take any of the preceding actions due to Force Majeure, unless and to the extent we are able to obtain any refunds from our Suppliers. Any refund under this section will less our 10% Administration Fee. This policy is based on the fact that Suppliers, who are often located outside the india, are not obligated to return non-refundable deposits or waive their cancellation fees in the case of Force Majeure. Further, it is not assured that we would easily be able to receive any refunds from our Suppliers once we have forwarded your deposits to them. Nor will we be able to pay you any compensation, costs or expenses you incur as a result. If you choose to cancel your Tour, our standard cancellation terms that govern when a traveler cancels apply. See above section titled “CANCELLATIONS BY YOU & REFUNDS.”
If TravQuench Travel private limited is affected by Force Majeure, TravQuench Travel private limited, if practicable, will notify you of the nature and extent thereof.
TravQuench Travel private limited will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/COVID-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances.
You agree that the sole remedy for any default by TravQuench Travel private limited arising under this Agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, TravQuench Travel private limited shall not be liable for any special, consequential, indirect, incidental or other damages arising out of this Agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if TravQuench Travel private limited has been advised of the possibility of such damages. You expressly waive any right it may have to recover such damages.
During your Tour, optional activities may be offered and furnished by other independent suppliers who are not affiliated with TravQuench Travel private limited in any way. Some of these optional activities carry with them various risks, including but not limited to attack by wild or domesticated animals, equipment/mechanical problems, and unexpected weather conditions, which can cause serious personal/bodily injury. Some of these activities include, but are not limited to: (1) horseback safaris; (2) walking safaris; (3) canoe trips; (4) camel safaris; (5) gorilla and chimpanzee trekking; (6) hot air balloon trips; (7) Masai village; (8) fishing excursions; (9) elephant back safaris; (10) bungee jumping; (11) white water rafting; (12) mokoro excursions; (13) snorkeling; (14) scuba diving (15) vehicle safari. Please be aware that although precautions may be taken by the suppliers to guard against such dangers, your safety cannot be guaranteed. Please also be aware that you are free to participate in such activities while you are on your tour and that these tours are not mandatory. However, you must understand that such participation will be at your own risk, and that TravQuench Travel private limited assumes no responsibility or other liability for your safety.
For these reasons, we strongly recommend that you obtain comprehensive travel insurance that covers trip interruption and cancellation, as well as adequate medical insurance that covers personal injury, medical expenses, repatriation costs, and evacuation expenses incurred during your tour. Note that insurance policies vary and may not provide coverage for the optional activities in which you might be engaged during your trip. For instance, some policies do not cover hot air ballooning while others might. Please consider the nature of your trip and the activities you will be engaged in and obtain appropriate insurance.
TravQuench Travel private limited cannot be held responsible for vehicle and/or equipment breakdowns or for injuries to person or property arising out of vehicle/equipment accidents which occur while on your tour.
Developing countries are not subject to the same ‘health and safety’ regulations that exist in the U.S. Many accommodations, activities, and rules are more relaxed than they would be in the U.S. Swimming pools are unlikely to be fenced or have depth markings. Steps around camps often do not have handrails and may be uneven. Camp pathways are sometimes uneven or slippery and may be unlit at night. You may come in contact with animals and insects. Some vehicles will not have seatbelts; particularly those in safari camps. Drivers may drive faster than you are comfortable with so please ask them to slow down. Life jackets may not be within reach so please ask for them. It is your responsibility to help manage your safety throughout your tour. If you ever feel uncomfortable, please speak up.
Please be aware that our tours may take you into close contact with wild animals. TravQuench Travel private limited cannot be held responsible for any injury or incident on the Tour. Please note that the majority of the safari camps are not fenced and wildlife moves freely in and around the camps. Always follow the safety instructions from the camp staff.
The tour price does not include travel insurance. TravQuench Travel private limited believes that your tour is a significant investment which you should protect and we strongly suggest that you obtain comprehensive travel insurance including medical coverage through a provider of your choice, covering medical, accident/life, evacuation, and repatriation, which might arise as a result of loss, damage, injury occurring to you, as well as any dependents and traveling companions for the duration of your tour. We also strongly recommend that you extend your coverage to include trip interruption and cancellation, curtailment, loss of belongings and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience. To protect your investment given that we cannot provide refunds in most instances, we also strongly urge you to consider a “cancel for any reason” travel insurance policy, which requires timely action as it must be purchased soon after your initial deposit. We will take no responsibility for any costs for loss of personal luggage, money, and goods, medical expenses, theft, damage or cancellation or curtailment of the adventure. You will be charged directly by the relevant service provider for any emergency services you may require.
Neither TravQuench Travel private limited nor its independent suppliers assume any responsibility for the attitudes, personalities, or behavior of other tour members. Normally, friendly and positive people take safaris. Those tour members who have serious health problems, mental or physical, are asked not to sign up for this tour.
If in our reasonable opinion or in the opinion of any person in authority associated with your tour feels that your behavior is causing harm, danger, or damage to property or person(s), embarrassment, harassment, or is persistently affecting the enjoyment of others, we reserve the right to terminate your vacation. Should this happen, no refund or compensation will be paid. Should you decide not to participate in certain parts of the tour or use certain goods included in the tour, no refunds will be made for those unused parts of the tour.
If you have any cause for complaint while on your Tour, you must immediately bring it to the attention of your tour guide or to TravQuench Travel private limited, who will attempt to resolve the situation. Failure to do so while you are on the tour will extinguish or reduce your ability to claim compensation from TravQuench Travel private limited. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.
If you are not satisfied after using this notice procedure, you must submit your complaint in writing to TravQuench Travel private limited on the registered email address sales@travquench.com within 2 days of the Tour’s end date.
It is your responsibility to be ready to embark on the tour as specified in the itinerary. We are not responsible for any losses due to cancelled or missed flights.
You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other tour members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, the local guide/supplier has the right in their sole discretion to remove anyone who they determine to detract from others’ enjoyment of the tour.
You agree that TravQuench Travel private limited may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the tour, you must inform us or your tour leader in writing before the start of the tour.
All information given in any brochure or otherwise advertised, (including electronic advertisements on the Internet) is, to the best of TravQuench Travel private limited knowledge, correct, but TravQuench Travel private limited cannot guarantee that all such information is accurate. Further, TravQuench Travel private limited reserves the right to change such information before any Tour. The photographs reproduced and information provided depict typical scenes experienced and details on each destination. However, the depicted or described subject matter may not necessarily be seen or experienced while visiting that destination as conditions and itineraries may change, be adjusted, etc. as explained these terms.
If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable, and which achieves, to the extent possible, the original objectives and intent of the original provision.
This agreement shall inure to the benefit of and be binding upon TravQuench Travel private limited and you and your respective heirs, legal and personal representatives, successors and assigns.
In addition, we shall not be liable for (a) expenses such as additional hotel nights and meals not specified in the individual trip itineraries, but which may be required to get to or from a trip start or end; (b) expenses due to the delay of a trip for any reason (e.g., bad weather, trail conditions, landslides, flooding, sickness, etc.); and (c) expenses incurred in recovering luggage lost by airlines, belongings left behind on a trip, or in shipping purchases or other goods home from abroad.
I agree that any dispute concerning, relating to, or referencing this agreement, or any other literature concerning my tour or the tour itself shall be resolved exclusively by binding arbitration according to the then existing commercial rules of the Delhi High Court. Such proceedings shall be governed by substantive Delhi High Court. The arbitrator and not any state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or part of this contract is void or voidable.
This agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.
I understand that acceptance of the Reservation Confirmation covering this Tour and payment thereof is an acceptance by me of these Terms and Conditions and for other tour conditions applicable to the tour. I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND AND ACCEPT THOSE CONDITIONS.
I certify that I have not recently been treated for, nor am I aware of, any physical or other condition or disability that would create a hazard to me or other members on this tour.
I intend to purchase travel insurance to cover my investment. Should I not purchase said insurance, I understand that I am assuming any financial loss associated with this Tour.
I have read this entire agreement, and I am signing it freely. I understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to me. I confirm that I have had an opportunity to have all of my questions about this agreement answered by TravQuench Travel Private Limited. My signature applies to all pages of this agreement.
